Se declaró la nulidad de todo lo actuado en la tutela de la referencia a partir del auto proferido por el Juzgado Quince Civil del Circuito de Bogotá, toda vez se le dio aplicación al Decreto 1382 de 2000 que resulta contrario a la Constitución, por lo tanto la Corte encontró que en este proceso ha debido inaplicarse y no podía servir de fundamento para otorgar la competencia al Tribunal que profirió la decisión de instancia.
En consecuencia, se devolvió el expediente al citado Juzgado para que realice trámite que corresponda conforme a la ley.
